1. By using diamonds.co.nz for any purpose, you agree to the current terms and conditions listed on diamonds.co.nz — whether or not you have actually read them. These terms and conditions are subject to change by diamonds.co.nz at its discretion at any time.
2. diamonds.co.nz and "the Administrator" refer to diamonds.co.nz and its officers.
3. Providing false or misleading information is in violation of these rules. Violators may be subject to civil and/or criminal penalties.
4. diamonds.co.nz reserves the right to change the procedures related to this service at any time.
5. It is agreed that having access to the information on diamonds.co.nz, or the storage of any personal or commercial information on diamonds.co.nz, constitutes having access — regardless of the current operating condition of your hardware and software or current internet conditions. Having access is the full extent of the responsibility of the Administrator and staff operating diamonds.co.nz.
6. Buyers agree to purchase the quantities stated in their order for the terms and amount specified in the listing history, including shipping and handling (if any).
7. diamonds.co.nz may periodically send email messages about the use of this service and the goods and services advertised.
8. The Administrator of diamonds.co.nz is the ultimate authority regarding any issue related to any information, software, hardware, or contents of diamonds.co.nz.
9. The law governing these terms and conditions, and the use of the diamonds.co.nz service, is the law of New Zealand.
10. diamonds.co.nz shall not be liable to any person for any matter arising from this web-based service except for direct fraud or direct reckless conduct on the part of diamonds.co.nz.
11. diamonds.co.nz is providing a platform to sell loose diamonds and diamond jewellery. diamonds.co.nz will do their utmost to ensure that the products listed are — to the best of their ability — correct, as follows:
    1. Gold, platinum, palladium, or any other metal content of jewellery listed on diamonds.co.nz being of correct karatage, as stamped on the items or represented in any other form.
    2. Diamond qualities and origins, as described on diamonds.co.nz — including independent diamond reports from all laboratories.
12. Most diamonds displayed on diamonds.co.nz are with one of our offshore suppliers and are subject to availability. If a particular diamond has been sold in the period between when a diamonds.co.nz customer places an order and when diamonds.co.nz receives payment, diamonds.co.nz will attempt to source a replacement that is as close as possible to the original and is at a similar price point.
13. Jewellery can take up to six weeks to manufacture from the time the design has been finalised.
14. Apart from manufacturing faults and your rights under the Consumer Guarantees and Fair Trading Acts of New Zealand, returns of jewellery or loose diamond purchases are possible only if all of the following criteria are met:

• The invoiced value of the item was under NZ$10,000 excluding GST.
• It has been less than 30 days since the item was received.
• The loose diamond — or the diamond set in jewellery — is a diamond that was already available in our New Zealand stock at the time of purchase (diamonds that show on our diamond search page when the "NZ Diamonds" check box is ticked)
• For jewellery, the piece cannot have been custom designed or varied in any way from one of the standard designs available on diamonds.co.nz, for example, through consultation with one of our designers online, in person or via phone.
• The item was not exported out of New Zealand through diamonds.co.nz's GST-free service.
• The item can be returned to diamonds.co.nz in its original condition, with all packaging and documentation.
